TORTURE HISTORYMr.N********* is a primary victim of torture and a resident of Mt.Elgon District, Kopsiro division, Kapkateny location, and Toywondet sub-location in Bungoma County. He is 37 years old living with his family of 11 people. Below he narrates how he was tortured by Moorland forces a group that terrorizes people in Mt.Elgon.During 2007 referendum i was chosen by Electoral Commission in Kopsiro as a driver to ferry ballot papers to various stations. I was to give out ballot papers to 3 stations ; Cheptonon, Kopsiro and Chebyuk.So on that fateful day, at around 11.00am on my way from Kopsiro to Chebyuk, I was attacked by people claiming that me and others who were in the vehicle have done propaganda; that the ballot papers were less which means we stole them so that their leader is not elected.Those people (a group of 10) started beating us starting with my boss who was B** K*******, then they took me out of the vehicle and went almost 100 meters opposite where the A.P were manning security with the purpose that they want to kill me.One of them removed a knife but fortunately I gained courage and strength and pulled myself from their hands and ran towards the vehicle shouting and screaming for help. I told my other colleague drive the vehicle so that we could get out of that place.Before leaving, I requested one of the A.P to help us get out of that place but he responded by telling them that people from Soy have guns something that shocked him. Afterwards the police accepted to take us but on the way they saw an erected roadblock. One of the A.p alighted and shot in the nearby bush whereby some of the boys (calling themselves Moorland forces) ran out and went ahead of them. They moved on but this time with a lot of speed but unfortunately the driver slowed down on reaching a pot hole, that is when the same people emerged and started shooting anyhowly.They shot at the two policemen, one on the leg and the other on the stomach, while the owner of the vehicle was shot in the chest, and finally I was shot on the thigh whereby the bullet went through my private parts and I was seriously injured.Just ahead of us were police from Ant stock unit which provided us with first Aid then they proceeded to Webuye district hospital. After two days I was transferred to Eldoret Referral Hospital where I was admitted for 2 months .After I was discharged, I stayed with my family in Eldoret town for another 1 month before they went home.On reaching my home area ,things were not good as those people were still looking after me .I was forced to relocate to Narok with my family for 3 years .I only came back after the government deployed Kenya army in Mt. Elgon .PRE-TORTURE HISTORYI was in good health before i was attacked and injured. I did farming and my family lacked nothing but nowadays I depend on others for survival.POST-TORTURE HISTORYI was affected physically, psychologically and sexually. Regarding physical consequences, the most recurring is headache, pain in all parts of the body, (legs, shoulders chest and ribs), Psychological consequences; depressed mood, anxiety, insomnia and low self-esteem. Sexual consequences; decrease in libido, fear of sexual contact/intimacy and sexual inhibition.PRESENT FAMILY SITUATIONThe client lives with a family of 11 people among them 4 children. After the attack, his family members strain to make ends meet. Mrs.W****** N******* W****** is a primary victim of torture and a resident of Kikwechi Village of Bungoma County. She is 38 years old living with her family of 7 people .She narrated to us how she underwent torture in the hands of gangsters.
I was in my house sleeping at around 12.00pm at night when I heard people shouting outside. I left my husband on the bed as I went out to find out what it was. They attacked me with pangas, rungus and clubs (Later I learnt that it was a militia group led a very well known politician). They cut me on the head and my right hand. I felt unconscious only to wake up the following day in Bungoma District Hospital where my right arm was amputated and later on I was referred to Moi Teaching and Referral Hospital in Eldoret (MTRH).
PRE-TORTURE HISTORY
My family used to have a comfortable life though I could not provide everything .They did not lack their basic needs; even paying their fees was not a problem. I could do everything on my own since I was in good health.
POST-TORTURE HISTORY
My right hand cannot function now .It pains a lot .I cannot involve myself in tedious work since it causes a lot of headaches and dizziness. This has really incapacitated me to the point that I have fully depended on my husband who has two wives.
Today my family lives in fear .Fear that the incident might repeat itself, especially since the perpetrators are known and live within us. Fear that my family will continue drowning in poverty. All we pray that the government provides adequate security, and that I get better treatment so that I can be able to provide for my family once again.
PRESENT FAMILY SITUATION
Her family composes of 9 people; her, the husband and seven children all whom are minors. After the attack my family strain a lot to make ends meet since all that we get is from hand to mouth.
CORE SERVICES PROVIDED BY MATESO
The client was offered with medication, counseling sessions, Psychotherapy, legal support, social support and follow-ups from the center. This was done by a doctor, counselor and psychiatric hired by the organization.
We also assisted in paying her hospital bills at MTRH and further facilitated her to record her statements with the police.

She is 60 years old and living with a family of 7 people in a 2 acre piece of land.It was on 29th April 2013 at around 12. Pm just in my house sleeping when I heard people shouting outside. In a short while like 20 seconds I heard a big knock on my door demanding that I open the door or face the consequences when they open it by themselves .I started trembling not knowing what to do as they continued banging the door. Unfortunately they opened the door and immediately entered our bedroom. As they started beating my husband I escaped through the window and ran towards banana plantation. Luck was not on my side as some of the attackers were outside and they saw me as I jumped through the window s they followed me and started beating and cutting my head with a panga.I felt unconscious only to wake up the following day admitted in Bungoma District hospital and later on referred to Moi Teaching and Referral Hospital (MTRH) Eldoret for CT scan.PRE-TORTURE HISTORYI was of good health before I was attacked and tortured. I was in my house when I heard people outside my house shouting. When I went out to find out what it was, they attacked me with pangas and clubs. They cut me on the head and hands. They also beat me on the chest with heavy metals. I lost consciousness and I finally regained it after three days when I woke up and found myself at Busia District Hospital.
PRE-TORTURE HISTORY
My family used to have a comfortable life. Although I could not provide everything, there was no single day that they lacked their basic needs. Even paying my children’s school fees was not a problem. I could do everything on my own since I was okay health-wise.
I was respected in my community due to my hard work. I was proud that my family could count on me for their provisions. They believed in my ability to provide for them.
Such an incident has never occurred in my life. I have not witnessed it around me, and neither has my relations gone through such a horrific experience.
Personally, I was not aware and neither was I prepared for such an event.
POST-TORTURE HISTORY
My left hand cannot function now. It swells and pains a lot, especially on the days that I have not taken the painkillers. I cannot lift anything heavy. I also cannot involve myself in tedious work since it causes a lot of headaches and dizziness. This has really incapacitated me to the point that I have become fully dependent on my wives, whom one is pregnant and the other has frequent shots of high blood pressure.
My children, today, are frequently sent home for school fees. This has really lowered my self-esteem. My social status in my community has also been lowered.
Today, my family and I live in fear. Fear that the incident might repeat itself; especially since the perpetrators are known and live within us (the neighborhood). Fear that my children’s education will be stopped at some point due to lack of finances. Fear that my family will continue drowning in poverty. All we can do is to hope that the government beefs up security, and that I can get better treatment, so that I can be able to provide for my family once again.
I also hope that our community can be trained on the awareness and preparedness of such events, such that, should it repeat itself, we will handle it better than now.

On 25th Feb 2015,(HMW) the deceased was arrested by police officers from Namwacha AP Camp at around 6.00am while on his way to the market where he was taking his phone for charging because he had assaulted his brother over land dispute. He was locked up in the cell and later on the corporal made a call to one of his brothers informing them of the arrest and also requesting them plus the complainant to go to the station so that they can discuss over the matter to be solved.
The family members together with the complainant went to the station and discussed and it was reached that the accused was to pay kshs 20,000 as compensation .He requested to be released so that he can go back home to sell his portion of land but it was not possible. So he excused himself to go for short call and the police officers followed him and a short while they came back with him, but he looked weak and unconscious due to beatings by them.
As soon as they arrived with him, they tied his hands on the tree and went on with the beatings. Unfortunately; he died while crying to be given some water as his brothers were watching desperately.

On 20/01/2015 at around 02:30pm, a group of 8 heavily armed police officers raided a changaa drinking den, at Muyayi village of Ndengelwa sub-location, Bukembe location, Kanduyi sub-county of Bungoma South District.
The police tortured and arrested several people. In that circumstance, they tortured the victim E***** N******.The police beat her and dumped her in a sugar cane plantion, about 100 meters from her house.
Prior information from eyewitness stated that police chased her because she was the proprietor of the illicit business and they wanted money from her.
When they left, family members rushed her to Bungoma district hospital, treated and discharged. The victim died afterward at her home. Eye witness further spotted the police vehicle registration number GK**** G.
So, far the responsible police officers from Bungoma police station have recorded statements and for family members who witnessed have also recorded statements. Police OB/19/1*/**/2015.
